WAIVER OF LIABILITY AND ASSUMPTION OF RISK RELATING TO COVID-19
The COVID-19 virus has been declared a worldwide pandemic by the World Health Organization. COVID-19 is known to be extremely contagious, and is reputed to spread by person-to-person contact, by contact with contaminated surfaces or by contaminated objects or in the air. People can be infected and show no symptoms and therefore can easily spread the disease. All the exact methods of spread are not completely known and there is no known treatment or cure that is one hundred percent (100%) effective for COVID-19. Experience has shown that COVID-19 can cause serious and potentially life threatening illness and death. I acknowledge that an inherent risk of exposure to COVID-19 exists in any public place where people are present, including on the premises of the Adventurers Club (“Club”).
Furthermore, I acknowledge that variants of Covid-19 have emerged, are likely present and that such variants are more transmissible and more dangerous. In addition, such variants may be able to cause reinfections, notwithstanding any prior immunity. It is unknown to what degree any vaccinations will be effective against Covid-19 and any of its variants.
ASSUMPTION OF RISK
I have read and understood the above warnings concerning COVID-19. I hereby voluntarily choose to assume all risks of being exposed to COVID-19, contacting the virus, and/or being in the presence of others that may have COVID-19.
WAIVER AND RELEASE OF LIABILITY(“WAIVER”)
I hereby forever release and waive my right to bring suit against the Club and its members, directors, officers, employees, contractors, agents, volunteers or other representatives in connection with my presence on the premises and with respect to COVID-19. I understand that this WAIVER means that I give up my right to bring any claims, including for personal injuries, death, disease or property losses, or any other loss, including, but not limited to, claims of negligence with respect to the Club
relating to COVID-19. By doing so, I give up any claim to seek damages, whether known or unknown, foreseen or unforseen with respect to the Club related to COVID-19.
I represent that I and those in my household (including the households of my guests and/or invitees) have not been diagnosed with Covid-19 within the last 30 days. I and my guests/invitees have no known symptoms of COVID-19, such as experiencing a fever or cough, shortness of breath or difficulty breathing, and that I have no reason to believe that I (and my guests/invitees) have been infected by COVID-19. If any change, I (or my guests/invitees) will not visit the Club.
BROADEST WAIVER & RELEASE POSSIBLE
This WAIVER is intended to be as broad as permitted by California law. This WAIVER is intended to be binding on my heirs, assigns and personal representatives. This Agreement is severable and that if any clause is found to be invalid, the balance of this Agreement will remain in effect, valid and enforceable.
By clicking on the “I agree” (checkbox) that is presented to me at the time of my Order, I indicate my assent to be bound by the WAIVER. Furthermore, I represent and warrant that I have authority to execute the WAIVER on behalf of each of my guests/invitees who visit the premises of the Club. In doing so, each has voluntarily assumed the risk of contacting Covid-19.
